China to Formulate Legislation Law

BEIJING, October 25 (Xinhua)-- China's highest legislative body is
seeking a legal solution to conflicts and confusion arising from
miscommunication among different departments in the process of
lawmaking.  The Commission of Legislative Affairs of the National
People's Congress (NPC) Standing Committee today submitted a draft of
the Legislation Law to the ongoing 12th session of the NPC Standing
Committee.  Numerous disputes have come about during law enforcement
because laws and regulations issued by different departments often
contradict each other, said a senior legislator.  Compared with some 350
laws and regulations published by the NPC and its Standing Committee in
the past two decades, the State Council drew up more than 700
administrative regulations within 20 years and local legislatures and
governments issued over 4,200 regulations in the recent five years. 
"The rush of administrative regulations issued by
governments at various levels has brought some problems to the
enforcement work.  So it is necessary to confirm limits of authority,"
Zhang Chunsheng, vice chairman of the commission, explained the bill to
legislators.  According to the draft, if the NPC Standing Committee
affirms that a regulation goes against the constitution or law, the
committee can instruct the relevant administrative body to revise or
repeal it.  The draft further defines the exclusive legislation scope of
the NPC and its Standing Committee, which includes enforcement measures
relating to citizens' rights of political and personal freedom; civil
codes on real rights, obligatory rights, intellectual property rights,
marriage and inheritance; lawsuits and enforcement systems and some
other major items concerning the fundamental systems of politics,
economy and laws of the state.  The draft provides detailed stipulations
on the limits of authority the regulations have at various levels. 
Zhang Chunsheng stressed that the legislation law, if adopted, would
help to standardize legislative work and implementation of the rule of
